... Fans Turn Out To Honor Patriots PHILADELPHIA (AP) - Major League Baseball does not have to rehire 10 umpires who are still out of work following a 1999 mass resignation, a three-judge federal appeals panel ruled Tuesday.
In a 2-1 decision, a panel of the 3rd U.S. Circuit Court of Appeals upheld the decision made in December 2002 by a U.S. District Court. Both sides appealed, with the commissioner's office claiming it should have not been ordered to rehire nine other umpires with back pay.
"Arbitration awards enjoy a strong presumption of correctness that may be overcome only in certain limited circumstances," which the parties could not show, Judge Jane R. Roth wrote in the majority opinion.
Judge Edward R. Becker dissented, saying he agreed with the commissioner's office, which said the dispute was not subject to arbitration. "Judge Becker had it right. They resigned. There was nothing to arbitrate over," said Rob Manfred, baseball's executive vice president of labor relations.
